MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA ON THE PROTECTION OF STRATEGIC COMMODITIES AND TECHNICAL DATA

I. PURPOSE
In accordance with the security objectives and responsibilities which the Republic of Korea and the United States share, both Governments agree that enhanced protection for strategic commodities and technical data is in the national security interests of both countries. This enhanced protection is designed to preclude the unauthorized transfer of such commodities and technical data to proscribed Communist destinations. Such protective measures will also serve to facilitate trade in strategic commodities and technical data between the two countries. Therefore, both Governments agree that the protective measures in this document will be instituted and effectively implemented.
¥±. PROTECTIVE MEASURES
1. Lists Procedure The list of strategic commodities and technical data to be controlled by the Republic of Korea and the list of proscribed Communist destinations to which exports of these controlled strategic technologies will be restricted will be determined by mutual consultations.
2. Import Certificate and Delivery Verification The Government of the Republic of Korea agrees to adopt import certificate and delivery verification documents consistent with the practice of the U.S. Government, and will make these documents available on request for imports of controlled strategic commodities or technical data.
3. Pre-License and Post-Shipment Checks Both Governments agree to cooperate in conducting pre-license and post-shipment checks in their respective territories when appropriate.
4. Re-Exports The Government of the Republic of Korea affirms that it will not permit re-export of U.S.-origin controlled strategic items which have been imported into the Republic of Korea without verifying that written approval of the United States Government has been obtained, when such approval is required.
5. End-Use The Government of the Republic of Korea will cooperate to ensure that controlled strategic commodities and technical data imported into the Republic of Korea are protected from end-uses and end-users not authorized in the export licenses.
6. In-Transit/In-Bond Both Governments agree to cooperate with and to assist each other in preventing the use of in-transit or in-bond facilities ashore in either country to evade the export controls of either Government. Both Governments further agree to cooperate to prevent re-shipment of items in-transit or in-bond when either Government suspects that the goods in question have been illegally exported.
7. Enforcement Both Governments agree to enforce the various assurances and conditions contained in their import certificates, end-user statements, and export licenses or export approvals for exports of controlled strategic commodities and technical data. When either Government suspects violations of its applicable laws relating to these items, both Governments will exchange information (including documentation) and coordinate to take appropriate action. Such corrective action could include detaining for the necessary time any items material to the investigation, and examinations of detained items to collect evidence.
¥². IMPLEMENTATION, INTERPRETATION AND CONSULTATIONS
Both Governments agree to consult annually on the operation of the provisions of this Memorandum of Understanding. The United States Government undertakes to assist the Government of the Republic of Korea as requested in establishing and implementing its strategic trade control systems. In addition, if any questions arise concerning the interpretation or implementation of this Memorandum of Understanding, both Governments agree to consult at the request of either party at the soonest possible date with a view toward reaching a mutually satisfactory solution within thirty days of the request. The obligations undertaken by the two Governments in this Memorandum of Understanding are subject to their respective national laws and regulations.
¥³. ENTRY INTO FORCE
This Memorandum of Understanding will enter into force on the thirtieth day after the day on which the two Governments shall have notified each other to the effect that all legal requirements for the entry into force of the Memorandum of Understanding have been met.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Memorandum of Understanding.
