대한민국 정부와 미합중국 정부간의 전략물자 및 기술자료 보호에 관한 양해각서

Ⅰ. 목 적
대한민국과 미합중국이 공유하고 있는 안보상의 제반 목적과 책임에 따라, 양국 정부는 전략물자 및 기술자료의 보호강화가 양국의 국가안보 이익에 부합된다는 점에 합의하였다. 이러한 보호강화는 그러한 전략물자 및 기술자료의 금지된 공산권 목적지로의 허가되지 않은 이전을 배제하기 위함이다. 이러한 보호조치들은 또한 양국간 전략물자 및 기술자료의 교역을 촉진시키는데 기여할 것이다. 양국 정부는 이 문서상의 보호조치들이 마련되고 유효하게 이해될 것임에 합의한다.
Ⅱ. 보호조치
1. 목록결정절차
대한민국에 의하여 통제될 전략물자 및 기술자료 목록과 이러한 통제 전략기술들의 수출이 규제될 금지된 공산권 목적지 목록은 상호 협의에 의하여 결정된다.
2. 수입증명서 및 통관증명서
대한민국 정부는 미합중국 정부의 관행과 일치하는 수입증명 및 통관증명 서류들을 채택하는 것에 동의하며, 이러한 서류들이 통제 전략물자 또는 기술자료의 수입을 위하여 요청될 경우, 제공되도록 한다.
3. 허가전 및 선적후 점검
양국 정부는 적절할 경우 각각의 영토내에서 허가전 및 선적후 점검을 이행하는데 협력할 것에 합의한다.
4. 재수출
대한민국 정부는 대한민국내에 수입된 미국 원산지 통제 전략품목의 재수출시 미합중국 정부의 서면동의가 필요한 경우, 동 서면 동의를 획득했다는 증명없이는 재수출되는 것을 허용하지 않을 것임을 확인한다.
5. 최종사용
대한민국 정부는 대한민국으로 수입된 통제 전략물자 및 기술자료가 수출허가서상에 허용되어 있지 않은 최종사용 및 최종사용자로부터 보호되도록 보장하는데 협력한다.
6. 경유/보세구역내
양국 정부는 어느 일방정부의 수출통제를 회피할 목적으로 어느 일방국가의 육상 경유 및 보세시설을 사용하는 것을 방지하는데 상호 협력하고 지원할 것에 합의한다. 양국 정부는 또한 어느 일방정부가 특정상품이 불법적으로 수출되고 있다는 의심을 가질 경우에는, 경유 또는 보세구역내에 있는 그러한 상품의 재선적을 방지하는데 협력할 것에 동의한다.
7. 시 행
양국 정부는 통제 전략물자 및 기술자료의 수출시 그들 국가의 수입증명서, 최종사용자 증명서 및 수출허가서 또는 수출승인서에 포함된 제반 보장조치 및 조건들을 시행하는데 합의한다. 만약 어느 일방정부가 이러한 품목들에 관련하여 적용 가능한 자국의 법규에 위반되었다는 의심을 가질 경우에는, 양국 정부는 정보를 상호 교환(서류 포함)하고, 적절한 조치를 취하기 위하여 협조한다. 이러한 시정조치는 조사에 필수적인 여하한 품목에 대하여 필요한 기간동안 유치하는 것과 증거를 수집하기 위하여 유치한 품목을 검사하는 것을 포함할 수 있다.
Ⅲ. 이행, 해석 및 협의
양국 정부는 이 양해각서 조항들의 운영에 관하여 매년 협의할 것에 합의한다. 미합중국 정부는 대한민국 정부가 전략교역 통제체제를 수립하고 이행하는데 있어서 요청받은 바에 따라 대한민국 정부를 지원할 것을 약속한다. 또한 이 양해각서의 해석 또는 이행과 관련하여 여하한 문제가 발생하는 경우, 양국 정부는 어느 일방 정부의 요청에 의거, 요청한 날로부터 30일 이내에 상호 만족할 만한 해결에 도달하기 위하여 가능한 가장 조속한 시일내에 협의할 것에 합의한다. 이 양해각서에서 양국 정부에 의하여 약속된 의무들은 각자의 국내법률과 규정에 따를 것을 조건으로 한다.
Ⅳ. 발효
이 양해각서는 양국 정부가 동 양해각서의 발효에 필요한 모든 법적 절차를 완료하였음을 상호 통보하는 날로부터 30일후에 발효한다.
이상의 증거로서, 하기 서명자는 각자의 정부로부터 정당한 권한을 위임받아 이 양해각서에 서명하였다.
1987년 9월 11일 워싱톤에서 동등히 정본인 한국어 및 영어로 2통씩 작성되었다.

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA ON THE PROTECTION OF STRATEGIC COMMODITIES AND TECHNICAL DATA

I. PURPOSE
In accordance with the security objectives and responsibilities which the Republic of Korea and the United States share, both Governments agree that enhanced protection for strategic commodities and technical data is in the national security interests of both countries. This enhanced protection is designed to preclude the unauthorized transfer of such commodities and technical data to proscribed Communist destinations. Such protective measures will also serve to facilitate trade in strategic commodities and technical data between the two countries. Therefore, both Governments agree that the protective measures in this document will be instituted and effectively implemented.
Ⅱ. PROTECTIVE MEASURES
1. Lists Procedure
The list of strategic commodities and technical data to be controlled by the Republic of Korea and the list of proscribed Communist destinations to which exports of these controlled strategic technologies will be restricted will be determined by mutual consultations.
2. Import Certificate and Delivery Verification
The Government of the Republic of Korea agrees to adopt import certificate and delivery verification documents consistent with the practice of the U.S. Government, and will make these documents available on request for imports of controlled strategic commodities or technical data.
3. Pre-License and Post-Shipment Checks
Both Governments agree to cooperate in conducting pre-license and post-shipment checks in their respective territories when appropriate.
4. Re-Exports
The Government of the Republic of Korea affirms that it will not permit re-export of U.S.-origin controlled strategic items which have been imported into the Republic of Korea without verifying that written approval of the United States Government has been obtained, when such approval is required.
5. End-Use
The Government of the Republic of Korea will cooperate to ensure that controlled strategic commodities and technical data imported into the Republic of Korea are protected from end-uses and end-users not authorized in the export licenses.
6. In-Transit/In-Bond
Both Governments agree to cooperate with and to assist each other in preventing the use of in-transit or in-bond facilities ashore in either country to evade the export controls of either Government. Both Governments further agree to cooperate to prevent re-shipment of items in-transit or in-bond when either Government suspects that the goods in question have been illegally exported.
7. Enforcement
Both Governments agree to enforce the various assurances and conditions contained in their import certificates, end-user statements, and export licenses or export approvals for exports of controlled strategic commodities and technical data. When either Government suspects violations of its applicable laws relating to these items, both Governments will exchange information (including documentation) and coordinate to take appropriate action. Such corrective action could include detaining for the necessary time any items material to the investigation, and examinations of detained items to collect evidence.
Ⅲ. IMPLEMENTATION, INTERPRETATION AND CONSULTATIONS
Both Governments agree to consult annually on the operation of the provisions of this Memorandum of Understanding. The United States Government undertakes to assist the Government of the Republic of Korea as requested in establishing and implementing its strategic trade control systems. In addition, if any questions arise concerning the interpretation or implementation of this Memorandum of Understanding, both Governments agree to consult at the request of either party at the soonest possible date with a view toward reaching a mutually satisfactory solution within thirty days of the request. The obligations undertaken by the two Governments in this Memorandum of Understanding are subject to their respective national laws and regulations.
Ⅳ. ENTRY INTO FORCE
This Memorandum of Understanding will enter into force on the thirtieth day after the day on which the two Governments shall have notified each other to the effect that all legal requirements for the entry into force of the Memorandum of Understanding have been met.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Memorandum of Understanding.
Done at Washington, in duplicate, in the Korean and English languages, both texts being equally authentic, this eleventh day of September, 1987.
