Detain and press criminal charges against Private John Christopher Humphreys and completely reform the unfair SOFA!

At two in the morning on May 15th, in the Shinchon area of Seoul, an intoxicated U.S. serviceman, Private John Christopher Humphreys, who is based at Camp Humphrey in Pyungtaek, attempted to commit murder by stabbing Mr. Hung Shik Park with a knife. Mr. Park was trying to prevent Private Humphreys and five other U.S. servicemen from committing acts of violence against Korean passers-by. First of all, we express our sincere hope that Mr. Park, who was seriously injured in attempting to protect other citizens from the violent behavior of the U.S. soldiers, will soon get well and completely recover from his wounds. We would also like to send our sincerest respects and appreciation to Mr. Park and his family.

1. Undeniable attempted murder! Detain and punish Private Humphreys!

The police are trying to handle this criminal case as a typical case of violent assault without making a thorough initial investigation into the crime. We believe, however, that this crime was not a case of accidental violent assault that happened by mistake, but a clear, definite and unquestionable case of attempted murder – assault with intent to kill. The following facts are evidence of this:

- The criminal suspect had a 25-cm long military knife in his possession, ready for use.
- The criminal suspect aimed the knife at the victim¡¯s throat, the most vital part of the human body.
- The criminal suspect threatened the victim, pointing the knife first at the right side of his throat, then moving the knife and stabbing him in the left side of the throat.
- The criminal suspect did not just cut the victim¡¯s throat, but stabbed it and inflicted a deep wound.
- The criminal suspect threatened the victim for about three minutes, which indicates that the suspect had enough time to think about what he was doing.
- The wound was about 3 to 3.5 cm deep.

Our assertion can be clearly justified if we examine the judicial precedent established by the Korean Supreme Court (Supreme Court, 22 December 1994, Judgment 94 DO 2511) which states: ¡°A criminal intent to commit murder shall be proven to have existed when a subject is believed to have been able to realize or foresee the possibility of the victim¡¯s death, without necessarily having to expect or aim at the death of the victim, as a result of the suspect¡¯s acts. The intent shall also be sufficiently proven by a willful negligence on the part of the suspect, not necessarily by a decisive intent to kill, during the course of the suspect¡¯s act.¡±

Therefore, we strongly urge that the investigation authorities perform a thorough and rigorous investigation into this case and detain and punish the suspect, Private Humphreys!

2. Completely reform the unfair and discriminatory Korean-U.S. SOFA (Status of Forces Agreement) that has become the main cause of crimes committed by U.S. soldiers.

What is the most fundamental cause of the never-ending crimes committed by U.S. soldiers stationed in Korea, even after the partial reform of the SOFA in 2001 and the death of two middle school girls? The unfair and discriminatory clauses of the SOFA are to blame. Almost all crimes repeatedly committed by U.S. service members in Korea are rarely punished and those suspected of such crimes have seldom been brought to justice. U.S. soldiers in Korea are well aware of the protection offered for them by the SOFA and that the SOFA discriminates by allowing or even encouraging the U.S. soldiers to commit crimes as they want, without having to worry about being accused, indicted or punished for those crimes. In order to put a definitive end to this unacceptable and unreasonable state of affairs, the SOFA must be completely revised as soon as possible.

In Japan, the Japanese and U.S. officials agreed to reform the Japanese-U.S. SOFA so that the Japanese law enforcement authorities can take full custody of suspects before prosecution in all cases of crimes committed by U.S. soldiers stationed in Japan. The current clauses of the Korean-U.S. SOFA -- which allow the Korean authorities to take custody of suspects only upon prosecution and only in cases of the pre-defined twelve serious crimes committed by U.S. soldiers in Korea, including murder and rape -- must be revised immediately, so that they are at least equal to the corresponding clauses in the Japanese-U.S. SOFA.

In this respect, we once again demand that the Korean and U.S. authorities immediately start to reform the unbalanced, biased Korean-U.S. SOFA.

3. We strongly condemn the Seodaemoon police station for allegedly harboring the suspect Private Humphreys!

The Seodaemoon police station in charge of this case hardly conducted an adequate initial investigation into this case and tried to handle it as a case of violent assault. Moreover, the head of the station¡¯s external affairs department tried to harbor the U.S. soldiers and attempted to conceal the real truth and essence of this crime, stating that the violent behavior of the servicemen should have been regarded as an aspect of American culture and that the whole incident occurred because of a lack of understanding of American culture on the part of the Korean citizens who were involved in the incident.

We therefore strongly condemn the Seodaemoon police station for their incorrect response, trying to read the mood of the U.S. forces in Korea, and sheltering the suspect instead of protecting the lives and property of Korean citizens.

We must face the reality that the lukewarm and passive attitude of the Korean investigation authorities toward the crimes committed by U.S. soldiers in Korea has also become another leading cause of the numerous crimes committed by American military personnel. Therefore we once again strongly urge the law enforcement authorities, including the police, to use all means without fail to promptly prosecute and punish the suspect, Private Humphreys, for attempted murder.

In addition, we demand that the commander-in-chief of the U.S. forces in Korea fully acknowledge that he bears complete responsibility for not exercising proper supervision of his personnel¡¯s behavior, and offer an appropriate and wholehearted apology, openly and officially, to the victim, his family and the Korean people, who were shocked and outraged by this crime. Further, we ask that the victim be offered sufficient and sincere compensation by the U.S. forces in Korea.
