박흥식 씨 살인미수 저지른 주한미군 존 이병을 구속 처벌하라 !
어제 15일 새벽 2시, 신촌에서 평택 캠프 험프리 부대 소속 주한미군 존 이병이 동료 미군 5명과 함께 술을 먹고 행패를 부리다 이를 말리는 박흥식씨(27세)의 목을 군용칼로 찌른 살인미수 의혹 사건이 발생했다.
천만다행히도 피해자 박흥식씨는 현재 연세대 세브란스 병원에서 응급수술을 받고 간신히 생명을 건졌다.
우리는 존 이병과 주한미군이 사람의 목숨까지도 앗아갈 수 있는 흉악한 중대범죄를 저지르고 박흥식 씨와 그 가족들에게 씻을 수 없는 상처를 준 데 대해 온 국민 함께 분노하며 이를 강력히 규탄하는 바이다.
무엇보다 우리는 이번 사건이 주한미군에 의한 단순 상해 사건이 아니라 살인미수 의혹을 강하게 불러일으킨다는 점에서 더욱 분노하지 않을 수 없다.
평통사가 당시 사건의 목격자를 조사한 결과 존 이병과 그 일행은 차도에서 괴성을 지르고 드러누워 교통을 방해하였으며, 택시를 세워놓고 범퍼와 본네트를 발로 차는 등 온갖 행패를 부렸다는 것이다. 목격자들은 존 이병이 미군들을 말리던 박흥식 씨를 위협하는 과정에서 실수로 목을 찌른 것이 아니라 박씨의 오른쪽 목에 칼을 대고 위협하다가 25Cm나 되는 군용칼로 왼쪽 목을 의도적으로 깊숙이 찔렀다고 증언하고 있다.
이는 존 이병이 25Cm나 되는 군용칼로 박씨의 목을 찌를 경우 사람의 목숨을 앗아갈 수 도 있다는 점을 알면서도 박 씨의 목을 찌른 것이라는 점에서 살인미수로 볼 만한 충분한 정황이 있었다는 것을 말한다.
이에 우리는 미국의 눈치를 보며 이번 사건을 단순 상해치상죄로 처리하려는 한국경찰을 강력히 규탄하면서 존 이병의 살인미수 의혹에 대해 철저히 수사하고 그 내용을 즉각 공개하며, 기소와 동시에 구속처벌할 것을 강력히 촉구한다.
만약 한미당국이 이번 사건의 진상을 은폐하고 주한미군을 엄중하게 처벌하지 않을 경우 범국민적 투쟁에 직면할 것임을 강력히 경고해 둔다.
다음으로 우리는 존 이병 등 미군들이 살인미수 의혹을 불러일으키는 흉악범죄를 저지르고도 반성하기는커녕 자신들의 범죄를 부인하는 파렴치한 행위를 서슴치 않고 있는 데 대해 충격과 분노를 금할 수 없다.
미군들의 이러한 처신은 우리 국민과 사법주권을 철저히 무시하는 것으로 2002년 여중생 고 신효순, 심미선 양 살인사건 이후에도 주한미군의 오만한 태도가 전혀 바뀌지 않았다는 것을 명백히 보여주는 것이다.
더욱이 주한미군 당국이 이번 사건에 대해 단순 유감입장만을 밝힌 것은 이번 사건에 대한 진심 어린 사과와 진상규명 및 엄중 처벌을 통한 재발방지 약속을 바라는 우리 국민의 뜻을 정면으로 짓밟는 것이다.
끝으로 우리는 이번 사건에서 불평등한 한미SOFA를 전면 개정되지 않고서는 미군 범죄를 결코 막을 수 없다는 것을 명백히 확인된 만큼 한미당국이 SOFA개정에 즉각 나설 것을 강력히 촉구한다.
특히 미군범죄자에 대한 실질적인 초동수사가 가능하도록 하고 모든 미군범죄자의 신병을 기소와 동시에 한국측에 인도하며 이번 사건처럼 살인미수 의혹이 있는 흉악범죄에 대해서는 즉시 구속할 수 있도록 불평등한 조항이 개정되어야 한다.

Declaration
Arrest, confine, prosecute and punish the U. S. soldier Second-class Private first-named John to the fullest extent of the Korean law for attempting to murder Mr. Hung Shik Park.
At two in the morning on May 15th in Shinchon area of Seoul, an alleged attempted murder case happened when a drunken U. S. Second-class Private first-named John from Camp Humprey in Pyungtaek committed a terrible outrage to innocent Korean by-passers together with five other drunken U.S. soldiers and fatally stabbed Mr. Hung Shik Park, who was trying to stop the ugly outrage by the soldiers, in the throat. Fortunately, Mr. Park was carried to Severance Hospital of Yonsei University, underwent emergency surgery and lived.
We, along with all Korean people, furiously rage against John and other U. S. soldiers for committing a brutal, wicked and ugly crime that could take human lives with no sense of being a human, hurting Mr. Park fatally and giving Mr. Park and his family an unforgettable wound and we strongly condemn those U. S soldiers accountable for this terrible crime.
Above all, we are even more furious in that this crime is not just a mere case of violent assault but a serious case of alleged attempted murder. SPARK (Solidarity for Peace and Reunification of Korea) questioned witnesses of the incident and learned that John and his party committed all kinds of bad behavior imaginable on a public road. They yelled and screamed in the middle of traffic lanes lying on the ground and interrupting traffic. They stopped a taxi and kicked its bumper and hood. The witnesses further testify that John did not stab Mr. Park by mistake while threatening him. They are saying that John pointed his 25CM military knife to Mr. Park's throat for a moment and stabbed him deeply and intentionally in his left throat. This definitely proves that this case must be regarded as an attempted murder in that Private John stabbed Mr. Park's throat knowing that stabbing Mr. Park or a person in the throat with 25CM military knife could kill him.
In this respect, we strongly condemn those Korean police officers who are trying to read the mood of U. S. Military in Korea and handle this case of terrible crime as a mere case of violent assault. We very strongly urge the Korean police to investigate this alleged attempted murder case committed by Private John thoroughly and perfectly, disclose the result of the investigation immediately and openly and charge, confine, prosecute and punish the attempted murderer.
Also, we strongly warn that, in the event the Korean and U. S. authorities in charge of this case try to conceal the facts and truths for this ugly crime and don't bring John and those accountable for this crime to justice of the Korean law, they will have no choice but to face a very strong, nationwide campaign against them by all Korean people.
Furthermore, we are shocked and outraged to see that those pitiful creatures in the U. S. military forces including Second-class Private John are still behaving shamelessly, impudently and disgracefully denying their inhuman crime instead of feeling sorry for what they have done.
With this kind of ugly behavior, the U. S. military in Korea are insulting and humiliating the Korean people and the precious rights of Korean Justice System. Further, this clearly indicates that the inherent and unjustifiable arrogancy of the U. S. military against the Korean people has never changed even after the terrible murder of two innocent Korean middle school girls, Shin Hyo Soon and Shim Mi Sun in 2002.
As usual, the U. S. military authorities merely and routinely announced their feeling of regret for this incident. This is a direct insult against the will of Korean people that hopes for definite promise for prevention of recurrence of such a crime through wholehearted apology by the U. S. military to the Korean people and close examination into the guilt of and severe punishment on all those responsible for this terrible, ugly and inexcusable crime.
Lastly, we very strongly urge again that the Korean and U. S. authorities step forward to the complete modification, correction and amendment of the SOFA as we reconfirmed in this incident that there is absolutely no way to put an end to crimes committed by U. S. soldiers unless the unfair SOFA is completely modified, corrected and amended. Particularly, all unfair terms and conditions must be immediately modified, corrected and amended so that the Korean law enforcement agencies can perform initial investigations against U. S. military criminal suspects and take the custody of them upon prosecution. For serious crimes like this case, SOFA must allow the Korean law enforcement agencies to confine the U. S. military criminal suspects for such crimes even before criminal prosecution.
